Specifically, it has come to our attention that you have violated and continue to violate the YouTube Terms of Service and the YouTube API Services Terms of Service in creating, offering, marketing, and operating Juno for YouTube. As you acknowledge on your website, Juno for YouTube provides a modified version of the YouTube.com web user interface. You have also modified the native YouTube.com watch experience, by redirecting users from YouTube's first-party watch player to the third-party embedded player, among other changes to the functionality of the page. As you know, by accessing and using the YouTube Platform, including by your participation in the YouTube API Developer Program beginning on or about November 3, 2014, you are bound by the YouTube Terms of Service at all times, which are posted at www.youtube.com/t/terms. Compliance includes, without limitation, not altering, modifying, or otherwise using the Service (including any Content) in violation of the YouTube Terms of Service. We also note that Your Client makes use of or strongly alludes to YouTube's trademarks and iconography. These actions may confuse consumers as to whether Your Client is affiliated with or approved by YouTube. We strive to keep YouTube a safe, responsible community, and to encourage respect for the interests of millions of YouTube creators, including their ability to monetize their content and develop their audience. We are also excited about the opportunities that the Apple Vision Pro offers for creators and viewers to interact with the YouTube platform in new ways. In order to protect the YouTube ecosystem, we require that developers comply with the YouTube Terms of Service, YouTube API Services Terms of Service, and Developer Policies, as applicable (terms defined here will have the meanings assigned to them in the applicable terms and policies). Please respond in writing by no later than May 3, 2024, to confirm that Your Client has ceased to modify the YouTube Service in violation of the YouTube Terms of Service. Please also include in your response confirmation that Your Client will abide by the API Branding Guidelines set out at https://developers.google.com/youtube/terms/branding-guidelines.
